1. Who you are contracting with
The Mystic's Path (the "Service") is provided by Alida McDaniel, a sole proprietor trading as The Mystic's Path ("we", "us", "our"). These Terms form the agreement between you and Alida McDaniel.
2. Acceptance
By creating an account, subscribing, or continuing to use the Service you agree to these Terms. If you do not agree, please stop using the Service. You confirm you are of legal age in your country, and where you use the Service on behalf of an organisation, that you have authority to bind it.
3. What the Service is
The Service is a 12-month guided personal development programme built on the structure of the Hero's Journey, delivered as weekly quests, daily check-ins, journal prompts and progress tracking. It is educational and reflective in nature. It is not medical, psychological, financial or legal advice, and it is not a substitute for care from a qualified professional.
4. Your account
You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us promptly if you suspect unauthorised use.
5. Licence and acceptable use
We grant you a limited, non-exclusive, non-transferable right to access the Service for your own personal, non-commercial use within your chosen plan.
You must not misuse the Service. In particular, you must not:
- use the Service unlawfully or for any fraudulent purpose, or send spam;
- infringe our intellectual property or that of any third party;
- interfere with the security or integrity of the Service, including introducing malware, probing or scanning our systems, or scraping content;
- reverse engineer, resell, redistribute or share access to the Service;
- circumvent technical limits, paywalls or usage restrictions.
6. Your content
You keep ownership of the journal entries, reflections and check-in data you create. You grant us a limited licence to host, store and process that content solely to operate and provide the Service to you. You can export your entries at any time from your account page.
7. Our intellectual property
We own the Service and all intellectual property in it, including the curriculum, quests, prompts, written material, software, design and branding. Nothing in these Terms transfers ownership to you.
8. Payment, billing and subscriptions
Membership is offered as a monthly or annual subscription, each beginning with a 7-day free trial. Current prices are shown on our pricing page. Subscriptions renew automatically until cancelled, and you can cancel any time from your account page.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy.
9. Service availability
We aim to keep the Service available and working well, but we do not guarantee it will be uninterrupted, timely, secure or error-free. We may change, update or discontinue features from time to time.
10. Suspension and termination
We may suspend or terminate your access if you materially breach these Terms, if payment fails or is not made, if there is a security or fraud risk, or for repeated or serious policy violations. You may stop using the Service and delete your account at any time from your account page. When access ends you may export your data beforehand; after deletion your content is removed from our systems.
11. Warranties and liability
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing here excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
12. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
13. Assignment, force majeure and changes
You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond their reasonable control. We may update these Terms and will post the revised version here with a new date.
14. Governing law
These Terms are governed by the laws of the State of California, United States, and the courts of that state have exclusive jurisdiction, without affecting any mandatory consumer rights in your country of residence.
